Purpose and acceptance

These terms govern access to the Mall of the World website and how it is used. Mall of the World is a virtual shopping centre: shops present their products in 3D places and in catalogues.

By using the site, you accept these terms. If you do not accept them, do not use the site.

Definitions

• The site: the Mall of the World website, with its towns, malls and 3D shop windows.
• Shop: a registered merchant who presents and sells its products on the site.
• Customer: anyone who browses the site or places an order.
• My Mall: the space where a customer gathers shops and products, and finds their history if they accepted it.
• Account: the personal space created to place orders or to manage a shop.

Access to the site

The site is free for customers. It works on a phone, a tablet or a computer. The 3D visit needs a fairly recent device; a lighter version is offered on phones.

We make every effort to keep the site available, but we do not guarantee uninterrupted access. Maintenance or a failure may make it unavailable for a while.

Account

An account is needed to place orders, keep a history or manage a shop. You provide accurate information and keep it up to date.

Keep your password secret. You are responsible for actions taken with your account. Tell us at once if you notice unauthorised use.

You can ask for your account to be deleted at any time, as explained in the privacy policy.

Shops

Each shop is an independent seller. The sale contract is between the customer and the shop, not the platform. The platform connects shops with customers and provides the selling space.

The shop is responsible for the description, price, availability and compliance of its products. Its legal details are shown on its page.

Prices

Prices are shown in the shop's currency. Where the law requires it, they include taxes. Delivery fees are shown before you confirm the order.

You pay the price shown when you place the order. A clear pricing error may be corrected before confirmation; in that case you may cancel the order free of charge.

Orders

When you confirm your basket, the site creates one order per shop. If your basket holds products from three shops, you receive three separate orders, each with its own delivery.

An order is confirmed when you receive the confirmation. If a product is no longer available, the shop may refuse or change the order and will inform you. If you have already paid, you are refunded.

The shop prepares and ships its order. You can follow the status of each order in your account.

Payment

Payment methods are those shown when you order, depending on the shop and the country. Payment can be made online or on delivery.

When online payment is offered, card details are processed by the chosen payment provider, not by the site. [To confirm according to the provider chosen.]

Delivery and collection

Delivery times and fees are set by the shop. They depend on the area, the delivery method and the time slot you choose.

If the shop offers collection in store, the collection terms are shown on the order.

On receipt, check your parcel. Report any problem to the shop within the period stated on the order.

Returns, exchanges and withdrawal

Each shop states its return and exchange policy. The right of withdrawal and its time limits depend on the law of the shop's country.

Some products may be excluded from the right of return where the law allows, for example personalised or perishable goods. [Time limits and exceptions by country to be set after legal review.]

Guarantees and after-sales service

Products are covered by the legal guarantee of conformity and the guarantee against hidden defects, according to the law of the country. The shop provides after-sales service for its products. The platform can help you contact it.

Complaints

If something goes wrong, contact the shop first. If the disagreement continues, write to the platform at the address given in the legal notice.

Remedies and mediation procedures provided by the law of your country remain open to you.

Content you publish

The texts, photos and other content you publish must be accurate, respectful and lawful. You keep your rights in your content. You only allow us to display it on the site for as long as the service needs it.

Prohibited uses

You must not:

• sell or present illegal or counterfeit products;
• impersonate a person or a shop;
• try to access the site or its data without authorisation;
• extract large amounts of data from the site;
• disrupt the site or its services;
• use the site to commit fraud.

Intellectual property

The site, its graphics, its 3D scenes and its code are protected. Brands, logos and products of shops belong to their owners. Demonstration shops and brands are fictional.

You may not copy these elements without written permission.

Personal data and cookies

Your data is processed according to the privacy policy. Cookies and browser storage are described in the cookie policy.

Liability

The platform is not responsible for products sold by shops or for their delivery. To the extent the law allows, it is not liable for indirect damage either.

Nothing in these terms limits a liability that the law does not allow to be limited.

Force majeure

No party is liable for a delay caused by an event it cannot control, such as a power or internet outage, a disaster or a decision by the authorities.

Suspension and closure

We may suspend an account that does not follow these terms. A suspended shop can no longer sell. Orders in progress are handled according to the law.

Changes to these terms

We may change these terms. For an order already placed, the terms in force when the order was placed apply.

Applicable law

Sale contracts are governed by the law of the country where the shop is established. Other matters are governed by the law of the publisher's country. The competent court and the rules by country will be set after legal review.
